1. Acceptance of Terms
Welcome to XPECOL ("Platform," "we," "us," or "our"). By accessing, registering for, or using our website, mobile application, and services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you may not access or use our Services.
2. Definitions
"Customer" or "User" means an individual who registers on the Platform to search for and book Services.
"Service Professional" or "Professional" means an individual or business entity registered on the Platform to offer and provide services to Customers.
"Service" or "Booking" means the task or job performed by a Service Professional for a Customer, arranged through the Platform.
"Content" means any text, images, reviews, profiles, or other data uploaded to the Platform.
3. The Platform's Role
XPECOL is a marketplace technology platform that facilitates connections between independent Service Professionals and Customers seeking services. XPECOL is not an employer of Service Professionals. Professionals are independent third-party providers solely responsible for their services, workmanship, conduct, and compliance with all applicable laws (including licenses, insurance, and tax obligations). We do not endorse or guarantee the quality, safety, or legality of any services provided.
4. Account Registration and Eligibility
You must be at least 18 years old to use the Services.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You agree to provide accurate, current, and complete information during registration and to keep it updated.
5. Booking and Payment Terms
For Customers: By booking a Service, you agree to pay the total price displayed, which may include the Professional's fee, Platform fees, and any taxes. Payment is processed securely through our third-party payment gateway. Cancellation may be subject to fees as per our Cancellation Policy.
For Service Professionals: You set your service prices within parameters allowed by XPECOL. You authorize us to collect payment from Customers on your behalf, deduct our Platform commission and any applicable fees, and remit the balance to you according to our payment schedule. You are responsible for issuing any invoices or tax documents directly to the Customer if required by law.
6. User Conduct and Responsibilities
You agree not to use the Platform for any unlawful purpose or to post harmful, fraudulent, or misleading Content.
Customers agree to provide a safe and appropriate worksite and necessary information for the Professional to complete the Service.
Service Professionals agree to provide services with reasonable skill, care, and in accordance with industry standards. You are responsible for your own tools, materials (unless agreed otherwise), and insurance.
7. Reviews and Content
Users may post reviews and content. You grant XPECOL a license to use this Content for operating and promoting the Platform. Reviews must be truthful and not defamatory. We reserve the right to remove any Content at our discretion.
8. Cancellation and Refund Policy
Specific cancellation windows and refund eligibility will be detailed per service category and communicated at the time of booking.
Refunds, when applicable, will be processed to the original payment method.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XPECOL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICES OR INTERACTIONS WITH OTHER USERS. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT OF FEES YOU HAVE PAID TO US IN THE LAST 6 MONTHS.
10. Dispute Resolution Between Users
XPECOL encourages Users to resolve disputes amicably. We may, at our sole discretion, assist in resolving disputes but are under no obligation to do so. You release XPECOL from any claims related to disputes arising from Services.
11. Termination
We may suspend or terminate your account and access to the Services at any time, for any reason, including if we believe you have violated these Terms.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via the Platform or email. Continued use after changes constitutes acceptance of the new Terms.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Chhattisgarh.
